Terms of Service
Last updated: 21 October 2026
These terms are the agreement between you and Vega ("Vega", "we", "us"), the New Zealand business operating vegaservers.com, whose details appear on our invoices. They apply when you create an account, order or use any of our services, or use our API. Please read them. If you do not agree, do not use our services.
1. Our services
We provide game server hosting, virtual private servers, web hosting and related services, plus custom services agreed with you (together, the "Services"). The details of each Service, including its resources, price and billing cycle, are set out when you order it and on your invoices. For a custom service, the description and price on your service page and invoices form part of this agreement.
2. Your account
- You must be at least 18 years old to hold an account. If you are younger, a parent or guardian must create the account and accept these terms, and they are responsible for everything done under it.
- Information you give us must be accurate and kept up to date, including a working email address. We send important notices, invoices and renewal reminders by email.
- You are responsible for keeping your password, linked sign-in accounts and API keys secure, and for all activity under your account. Tell us straight away if you think your account has been accessed without your permission.
- One person or business should not share an account with unrelated third parties. If you resell or provide servers to others, you remain responsible to us for their use.
- We may refuse to open or may close an account where we reasonably suspect fraud, abuse or a breach of these terms.
3. Prices, tax and billing
- Prices are shown in New Zealand dollars (NZD). Goods and Services Tax (GST) is included or added as shown at checkout and on your invoice.
- Hourly services are charged from your account credit for each hour the server is active. A partial final hour is charged as a full hour. Hourly billing continues until you cancel the server or it is terminated, even if the server is switched off, because its resources remain reserved for you.
- Monthly, quarterly, six-monthly and yearly services are invoiced in advance for the coming period. We usually issue the invoice about a week before it is due. The price you signed up at stays the same for the term you have paid for. We may change prices for future terms and will tell you by email before any change affects you.
- One-time charges are invoiced once and are due on the invoice due date.
- Account credit is money you add to your account to pay for hourly services and, if you choose, invoices. Credit is personal to you and cannot be transferred or withdrawn as cash, except as set out in section 5.
- If your credit runs out, your hourly servers are paused until you add more credit.
- Pricing, game requirements and resource limits shown on our website may change. A change does not affect a service you have already paid for until its next renewal.
4. Payments and saved cards
- Card payments are processed by Stripe. We do not see or store your full card number.
- For some services, including custom services, you may agree that we can charge a payment method saved with Stripe automatically when an invoice falls due. By agreeing, you authorise us to charge that method for each invoice for those services until you tell us to stop or the service ends. You can ask us to remove a saved payment method at any time by opening a ticket.
- If an automatic payment fails, we will try again a limited number of times, tell you by email, and ask you to pay the invoice another way. Failed payments do not remove your obligation to pay.
- If you dispute a charge, please contact us first so we can fix it quickly. Opening a chargeback without contacting us may lead to suspension of your account while the dispute is resolved, and we may recover the chargeback fees our payment provider charges us.
- We may carry out fraud checks and may delay or cancel an order if a payment looks suspicious.
5. Cancellations, changes and refunds
- You can cancel a service at any time from your client area. For monthly, quarterly, six-monthly and yearly services you can cancel at the end of the current paid term, which is the default, or immediately. If you cancel immediately, there is no refund for the remaining paid term unless we agree otherwise.
- When you cancel an hourly service, billing stops once it is cancelled, and you are charged for hours used up to that point.
- You can upgrade or downgrade the resources of eligible game servers, and switch between billing cycles, from your client area. Changes in resources are charged or credited in proportion to the time left in your current term. A switch from monthly or yearly billing to hourly takes effect at the end of the term you have paid for. Reducing storage may remove data that no longer fits, so back up first.
- Unused account credit can be refunded within 14 days of the credit being added. After that, credit is not refundable, but remains available to use.
- If you terminate a server through our API, any unused time on a prepaid term is returned to your account credit as described in the API documentation.
- If we fail to provide a Service you have paid for, we will fix the problem, or, if we cannot, refund the part of the fee that relates to the time you did not receive the Service.
- Nothing in these terms limits any rights you have under New Zealand consumer law that cannot be excluded.
6. Late payment, suspension and termination for non-payment
- If an invoice is not paid by its due date, we send a reminder. We normally suspend the services on that invoice a few days after the due date. Suspended services are unavailable but are kept for you, and are restored when the invoice is paid.
- If an invoice remains unpaid for about two weeks after its due date, we may terminate the services on it. Terminated services and the data on them are deleted and cannot be recovered.
- You remain responsible for amounts owing for the time before termination. We may use a debt collection agency for unpaid amounts and may recover reasonable collection costs where the law allows.
7. Acceptable use
You must use the Services lawfully and fairly. You must not, and must not allow anyone else to, use the Services to:
- break any New Zealand law or the law of any place where your server or users are located;
- host, share or link to child sexual abuse material, or any content that sexually exploits or endangers children, which we report to the authorities;
- launch or take part in denial-of-service or other attacks, port scanning, brute force attempts or any other attack on a network, server or person;
- host malware, phishing pages, botnet controllers or tools whose main purpose is to attack others;
- send spam or run open relays or open proxies;
- mine cryptocurrency, or run proof-of-work, proof-of-stake or similar workloads, unless we have agreed in writing;
- run workloads that are not the purpose of the Service you bought, such as running a game server plan as a general purpose VPS, or that use more than a fair share of shared resources and affect other customers;
- infringe copyright, trade marks or other rights, including by running pirated game software or breaching the licence or terms of a game, mod or platform. You are responsible for holding any licences or accounts your game needs, and for following the game publisher's terms;
- harass, threaten or defame others, or host content that is unlawful, hateful or promotes violence;
- interfere with the Services, our website or our API, avoid usage limits, or access anything you are not authorised to access.
You are responsible for the content on your servers and for anyone you give access to them, including players and administrators.
8. Our right to act on abuse
- We may suspend or terminate a Service immediately and without refund, if you breach section 7, if your use threatens the security or stability of our network or other customers, or if we are required to by law or by a request from a court, regulator or other authority.
- Where reasonable and safe to do so, we will tell you why and give you a chance to fix the problem first.
- We may remove or disable content that we reasonably believe is unlawful or breaches these terms, and we may pass information to the authorities where the law requires it or where we believe it is necessary to prevent serious harm.
9. Your data and backups
- You own your content and data. You give us permission to store, copy and process it as needed to provide the Services.
- You are responsible for keeping your own backups of anything important. Where a backup add-on is included in your plan, it is a convenience and not a guarantee. Backup slots are limited, and backups are removed when the service is cancelled or terminated.
- When a service is cancelled or terminated, the files and data on it are deleted. Please download what you need before then.
- We handle personal information in line with our Privacy Policy.
10. Service availability
- We work hard to keep the Services running and to protect them against attacks, including with DDoS mitigation. However, we cannot promise that the Services will be uninterrupted, error free, or that every attack will be stopped.
- We may carry out maintenance and, where we can, will give notice of planned work that is likely to affect you.
- The Services depend on third-party software and platforms, including the games you choose to run. We are not responsible for faults, changes or shutdowns of third-party games, mods or platforms.
- Unless we agree a written service level for a particular Service, no uptime guarantee applies.
11. API access
- API access is available to accounts that meet the requirements shown in your client area. We may change or withdraw API access if it is misused.
- An API key can act on your account, including ordering services that are paid for from your credit and terminating servers permanently, depending on the permissions you give it. Treat keys like passwords, give them only the permissions they need, and revoke any key you think has been exposed.
- You are responsible for everything done with your API keys, including charges and deletions, whether or not you intended them. We are not liable for loss caused by a key that was lost, shared or misused.
- API requests are rate limited and logged. You must stay within the published limits.
12. Private and restricted services
Some games or services are made available only to specific customers. If you are given access to one, you must not share it, offer it to others, or use it outside the arrangement agreed with us. We may withdraw access at any time for future orders. Existing paid services continue until the end of their term.
13. Our liability
- Consumers. If you are using the Services for personal, domestic or household purposes, the Consumer Guarantees Act 1993 and Fair Trading Act 1986 apply and nothing in these terms limits your rights under them.
- Businesses. If you are using the Services in trade or for business, you agree that the Consumer Guarantees Act 1993 does not apply to the Services, and that sections 9, 12A and 13 of the Fair Trading Act 1986 do not apply to our dealings, as it is fair and reasonable for you and us to be bound by these terms.
- To the fullest extent the law permits, we are not liable for indirect or consequential loss, loss of profit, revenue, data, players, goodwill or opportunity, or loss caused by events outside our reasonable control.
- To the fullest extent the law permits, our total liability to you for all claims arising from the Services in any 12 month period is limited to the amount you paid us for the affected Service in the 3 months before the event that led to the claim.
- Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including for fraud or for death or personal injury caused by negligence.
14. Indemnity
If you are a business customer, you agree to cover our reasonable losses and costs arising from a third-party claim caused by your content or by your breach of these terms, including your breach of section 7. We will tell you about any such claim and let you take part in dealing with it.
15. Ending this agreement
- You can stop using the Services and close your account at any time by cancelling your services and asking us to close your account.
- We may end this agreement or stop providing a Service by giving you at least 30 days' notice. If we do this without a breach by you, we will refund the prepaid fees for the period after the Service ends.
- Sections that by their nature should continue after the agreement ends, including payment obligations, liability and governing law, continue to apply.
16. Changes to these terms
We may update these terms from time to time, for example to reflect new services, new laws or changes to how we operate. For material changes, we will email you at least 14 days before they take effect. If you keep using the Services after the change takes effect, you accept the updated terms. If you do not agree, you can cancel your services before then.
17. General
- Notices. We may give notices by email to the address on your account, through your client area, or on our website. You can contact us at [email protected] or through a support ticket in your client area.
- Events outside our control. Neither of us is in breach for a failure or delay caused by something outside our reasonable control, such as natural disaster, power or network failure, upstream provider failure, large-scale attack, war or government action. Payment obligations are not excused.
- Entire agreement. These terms, together with the details of each Service you order and our Privacy Policy, are the whole agreement between us about the Services.
- If part is unenforceable. If any part of these terms is found invalid, the rest continues to apply.
- No waiver. If we do not enforce a right straight away, we have not given it up.
- Assignment. You may not transfer your rights or obligations under these terms without our written consent. We may transfer ours to a business that takes over the Services, and will tell you if we do.
- Governing law. These terms are governed by the laws of New Zealand. The courts of New Zealand have non-exclusive jurisdiction over any dispute. Before starting formal proceedings, please contact us so we can try to resolve the problem informally.
